Draft — not yet reviewed by a solicitor. This document reflects EchoAural's actual current pricing, trial, and data-retention practices, but has not had legal review. In particular, the liability and warranty sections use standard SaaS wording that a solicitor should check against UK law before this is relied upon commercially.

Terms of Service

Last updated: [date to be set when published]

1. Who these terms are between

These terms are an agreement between [legal entity name to be confirmed] ("EchoAural", "we", "us") and the school or teacher subscribing to the service ("you", the "School"). EchoAural is sold to schools and teachers for educational use; it is not intended for purchase directly by parents or students.

2. The service

EchoAural is an online listening-skills practice platform for GCSE/iGCSE Music (Cambridge 0410), including self-directed practice modules, Progress Mode, teacher-hosted Live Sessions, and homework assignment and tracking.

3. Free trial

New accounts receive a 14-day free trial with no payment required upfront. At the end of the trial, continued access requires a paid subscription as described below.

4. Pricing and billing

  • The subscription price is £99 per teacher per year, following the 14-day free trial.
  • Subscriptions run for a fixed 12-month term from the date of purchase.
  • Invoices are issued directly by EchoAural; there is currently no automated in-app card billing, so please ensure invoices are paid promptly to avoid a lapse in access.

5. Cancellation and refunds

Subscriptions are non-refundable once purchased and run for the full 12-month term. There is no early-cancellation refund. This reflects the fixed-term nature of the subscription and is standard for annual education-sector software licences; if you are unsure whether EchoAural is right for your school, please make full use of the 14-day free trial before subscribing.

6. What happens if a subscription is not renewed

  • Access to the service ends when the 12-month term expires, if not renewed.
  • Your data (teacher and student records, class and progress data) is retained for 90 days after expiry, during which you can renew and resume exactly where you left off.
  • If not renewed within 90 days, all associated data is permanently deleted. See our Privacy Policy for more detail.

7. Your responsibilities

  • You are responsible for keeping teacher and student login credentials secure, and for the accuracy of any student information you enter.
  • The service is for legitimate educational use by your school's staff and students only — accounts must not be shared outside your school, resold, or used for any unlawful purpose.
  • Your school remains responsible for its own safeguarding duties toward its pupils at all times — see our Safeguarding Statement for how EchoAural's own, more limited role fits alongside that.

8. Service availability

We make reasonable efforts to keep the service available and reliable, but we do not guarantee uninterrupted or error-free access. We may occasionally need to carry out maintenance that temporarily affects availability.

9. Intellectual property

EchoAural retains all rights in the platform, its content, and underlying software. You retain ownership of the data you and your students input (student names, answers, and similar records).

10. Liability

[Standard limitation-of-liability wording belongs here — e.g. capping EchoAural's liability at the fees paid in the preceding 12 months, and excluding indirect/consequential loss. This section specifically should be drafted or checked by a solicitor rather than relied on as written, since the right cap and exclusions depend on UK law applicable to a contract of this kind.]

11. Ending this agreement

Either party may choose not to renew at the end of the 12-month term. EchoAural may suspend or terminate access earlier if these terms are breached — for example, misuse of the service or non-payment.

12. Governing law

These terms are governed by the law of England and Wales, and any dispute will be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Contact

For any question about these terms, email james@echoaural.com.

14. Changes to these terms

We may update these terms from time to time. We'll update the "last updated" date above when we do, and for any significant change, we'll notify Schools directly ahead of their next renewal.
